El proceso se inició con un informe de 8 de septiembre de 2008 suscrito por un funcionario de la Sección de Análisis Criminal de la Fiscalía General de la Nación en la que se cita la versión del jefe paramilitar RODRIGO PEREZ ALZATE alias JULIAN BOLIVAR rendida ante la fiscalía 41 de la Unidad Nacional de Justicia y paz; allí se señala a JUAN CARLOS GALVIS GALVIS Y WILLIAM MENDOZA GOMEZ, -miembros del sindicato de Sinaltrainal- como autores de un atentado con bomba a las instalaciones de la empresa de Coca Cola de la ciudad de Barrancabermeja, hechos que supuestamente perpetrado por la guerrilla del Ejército Popular de Liberación EPL.
En este informe se señala a los paramilitares WILFRED MARTINEZ GIRALDO y SAUL RINCON CAMELO (condenados por el homicidio del dirigente sindical de la USO RAFAEL JAIMES TORRA) como supuestos testigos que conocen de los hechos.
Con fundamento en el informe anterior, el 26 de enero de 2010, la fiscalía 28 especializada de la Unidad Nacional contra el terrorismo –estructura de apoyo a la parapolítica- ordenó abrir investigación preliminar contra JUAN CARLOS y WILLIAM, al parecer, por el delito de TERRORISMO, ordenando escuchar en declaración a los paramilitares RODRIGO PEREZ ALZATE alias JULIAN BOLIVAR, WILFRED MARTINEZ GIRALDO y SAUL RINCON CAMELO.
El 23 y 24 de marzo de 2010, dentro de las instalaciones de la cárcel Modelo de Bucaramanga, sin presencia de abogado defensor y sin presencia del ministerio público, un funcionario de policía judicial recepcionó la declaración jurada de los paramilitares WILFRED MARTINEZ GIRALDO y SAUL RINCON CAMELO, en la que se observan graves contradicciones, pero además su intención de vincular a los dirigentes sindicales como determinadores del atentado.
Actualmente el proceso continúa en la fiscalía 28 de la Unidad Nacional contra el terrorismo en etapa preliminar, decretándose varias pruebas solicitadas por la defensa y otras de oficio; preocupa que la investigación se soporte exclusivamente en declaraciones amañadas e interesadas de paramilitares acogidos en la ley de Justicia y Paz, quienes desde su accionar sistemático pretendieron asesinar a quienes hoy en día señalan como autores de hechos punibles.
Es de anotar que los supuestos testigos de cargo son subalternos del paramilitar alias RODRIGO PEREZ ALZATE, reconocido jefe de bloque central Bolívar; desde que están en la ley de justicia están en contacto permanente en patios especiales de la cárcel dotados de computadores y facilidades de comunicación lo que ha permitido la maquinación de sus versiones.
Dentro de la etapa preliminar el fiscal podrá escuchar en versión libre a los imputados procediendo a abrir investigación formal, siendo llamados a indagatoria; o bien, puede ordenar el archivo de la investigación profiriendo auto inhibitorio; pero por la experiencia en la defensa de personas criminalizadas por razones políticas, la Unidad Nacional contra el Terrorismo se ha caracterizado por sus posturas poco garantistas en contravía al derecho de defensa y al debido proceso que le asiste a toda persona sometida a un proceso penal.

PENAL PROCESS AGAINST SINALTRAINAL UNION LEADERS
JUAN CARLOS GALVIS GALVIS AND WILLIAM MENDOZA GÓMEZ
The process began with the September 8, 2008 report registered by a civil employee of the Section of Criminal Analysis of the General Office of the public prosecutor of the Nation in which the version of the paramilitary chief RODRIGO PEREZ ALZATE alias JULIAN BOLIVAR rendered before the public prosecutor office 41 of the National Unit of Justice and peace is mentioned; on it, CARLOS GALVIS GALVIS and WILLIAM JUAN MENDOZA GÓMEZ, members of the Sinaltrainal union are pointed out as authors of a bomb attack at the facilities of the Coca Cola Company of the city of Barrancabermeja, facts that supposedly were perpetrated by the guerrilla of the Popular Army of Liberation, EPL.
This report points to the paramilitaries WILFRED MARTINEZ GIRALDO and SAUL RINCON CAMELO (convicted for the murder of USO union leader RAFAEL JAIMES TORRA) as alleged witnesses who know the facts.
Based on the previous report, on January 26, 2010, specialized prosecutor office 28 of the National Unit against terrorism - support structure of parapolitics - ordered the opening of preliminary investigation against JUAN CARLOS and WILLIAM, apparently for the crime of TERRORISM, ordering the listening of the statements of the paramilitaries RODRIGO PEREZ ALZATE alias JULIAN BOLIVAR, WILFRED MARTINEZ GIRALDO and SAUL RINCON CAMELO.
On the 23 and 24 of March 2010, within the premises of the Modelo prison in Bucaramanga, without the presence of Counsel and without the presence of the Attorney General's Office, an agent of the judicial police took the sworn statement of paramilitaries WILFRED MARTINEZ GIRALDO and SAUL RINCON CAMELO, in which there are serious contradictions, but also its intention to link the union leaders as instigators of the attack.
Today the process continues in the public prosecutor office 28 of the National Unit against terrorism in the preliminary stage and has been ordered a number of tests requested by the defense and others. It is a concern that the investigation is based exclusively on the rigged and interested statements of paramilitaries participants of the Justice and Peace Law, who from their systematic actions attempted to murder those who they accuse today as perpetrators of offenses.
It should be noted that the alleged witnesses are subordinate of paramilitary alias RODRIGO PEREZ ALZATE, recognized chief of the Bolivar central block, and since they have been under the Law of Justice and Peace, they have been in permanent contact in special yards in the prison with computers and communication facilities which has allowed the machinations of its versions.
In the preliminary stage the public prosecutor will be able to listen the accused in free version and proceed to open a formal investigation, and called to testify; or, can order the closing of the investigation under a writ of prohibition; but, as the experience shows in the defense of people criminalized for political reasons, the National Unit against Terrorism has been characterized by positions without any guarantee opposing the right of defense and due process that every person who is under a penal process is entitled.
