Asesinado Gilberto Espinosa Victoria

Condenamos el asesinato del miembro de Sinaltrainal GILBERTO ESPINOSA VICTORIA, ocurrido en Bugalagrande del Valle del Cauca,  aproximadamente  a las 19:55 horas del 13 de mayo de 2018. Gilberto fue trabajador de la multinacional Nestlé de Colombia durante 25 años en la fábrica de Bugalagrande. 

El hecho se presenta en el desarrollo de un conflicto colectivo que inicio con la presentación del pliego de peticiones por SINALTRAINAL a Nestlé de Colombia S.A. el 9 de abril de 2018. Desconocemos el motivo por el cual ocurrió este  lamentable hecho. 

Amenazas de muerte 

El 10 de febrero de 2018, aproximadamente las 11:40 horas, llegó a las instalaciones de SINALTRAINAL, ubicadas en la carrera 7 No. 6-35 del Barrio San Bernabé en el municipio de Bugalagrande, a través del servicio SERVIENTREGA, un sobre que contenía una AMENAZA DE MUERTE con los nombres de trabajadores afiliados a nuestra Organización Sindical SINALTRAINAL (GILBERTO ESPINOSA V., LUCIO LLANOS y OSCAR GORDILLO) y otro. 

A raíz de esta grave situación fue radicada la DENUNCIA respectiva en la FISCALÍA GENERAL DE LA NACIÓN en fecha 12 febrero de 2018, caso noticia: 768346000187201800510, departamento 76 – Valle del Cauca, 834 – Tuluá, 60 – Fiscalía General de la Nación, 00187 URI (UNIDAD DE REACCIÓN INMEDIATA). 

Las amenazas de muerte y el asesinato de GILBERTO ESPINOSA VICTORIA, sumado a la amplia lista de amenazas y asesinatos generan una gran incertidumbre y temor en los trabajadores  afiliados a SINALTRAINAL y sus familias. 

La respuesta a estos crímenes es una clara desatención del estado colombiano, que siendo conocedor del riesgo que vivimos, continúa con el desmonte de las MEDIDAS DE SEGURIDAD (esquemas y otros), la restricción de las mismas y la inoperancia que garantice la Seguridad y la Vida de los trabajadores, Afiliados a SINALTRAINAL y nuestras familias. 

La falta de acciones que brinden garantías de seguridad y vida para los integrantes de SINALTRAINAL y la ineficacia de la FISCALÍA GENERAL DE LA NACIÓN como instrumento investigativo que dé con los responsables y la justicia que los condene y repare las víctimas, hace que el estado colombiano sea el único responsable, ya que teniendo conocimiento de las amenazas de muerte contra GILBERTO ESPINOSA VICTORIA, NO tomo las medidas requeridas para garantizarle la vida. Lo anterior sustentado en la denuncia radicada oportunamente ante la FISCALÍA GENERAL DE LA NACIÓN. 

SINALTRAINAL condena estos crímenes que continúan atentando contra el libre desarrollo de la actividad sindical y  se suman a la larga lista de hechos violentos contra los integrantes del movimiento sindical y social y en particular de nuestro sindicato. 

Por todo lo anterior exigimos: 

PRIMERO: Que la Fiscalía General de la Nación investigue los hechos ocurridos el día 13 de mayo de 2018, a fin de que se establezca los autores inmediatos y mediatos, se capture y judicialice a los responsables del asesinato del integrante de SINALTRAINAL – GILBERTO ESPINOSA VICTORIA, se llegue a la VERDAD y se haga JUSTICIA. 

SEGUNDO: Nos informe por escrito el estado de las investigaciones realizadas por los hechos denunciados por SINALTRAINAL ante la FISCALÍA GENERAL DE LA NACIÓN en fecha 12 febrero de 2018, caso noticia: 768346000187201800510, por las amenazas de muerte, entre otros contra GILBERTO ESPINOSA VICTORIA, asesinado el 13 de mayo de 2018. Igualmente, las medidas tomadas por el estado colombiano para salvaguardar la seguridad y vida de los amenazados. 

TERCERO: Se garantice la SEGURIDAD y la VIDA de los Integrantes del Sindicato Nacional de Trabajadores del Sistema Agroalimentario – SINALTRAINAL, de los amenazados de muerte y los trabajadores de Nestlé de Colombia S.A., LUCIO LLANOS, OSCAR GORDILLO y  sus familias.

CUARTO. Ofrecemos nuestro saludo fraterno y nuestros sentimientos de solidaridad a su esposa e hija,  familiares, amigos y allegados del compañero GILBERTO.

Nestlé Employee Gilberto Espinosa Victoria Assassinated

We condemn the assassination of Sinaltrainal member Gilberto Espinosa Victoria in Bugalagrande (in the province of Valle de Cauca) at approximately 7.55pm on the 13th of May 2018. Gilberto was employed by the multinational Nestlé de Colombia S.A. for 25 years at the factory in Bugalagrande.

The assassination occurred at the same time as a conflict has been developing over a collective petition presented by our trade union to Nestlé de Colombia on the 9th of April 2018. As yet we do not know the motive for this lamentable attack.

Death threats

At approximately 11.40am on the 10th of February 2018 an envelope was delivered by commercial courier to the Sinaltrainal office in Bugalagrande. The envelope contained a death threat that specifically identified and named as targets Nestlé workers in Bugalagrande affiliated with Sinaltrainal. A second letter in the envelope stated that if the regional directors did not resign they would be considered ‘military targets’ proclaiming, among other gross insults and threats, “Death to the Rats at Nestlé”.

As a result of this grave situation a denunciation was sent to the office of the Prosecutor General of the Nation on the 12th of February 2018 (specifically, to the office’s Immediate Response Unit located in the nearby city of Tulua, case No. 768346000187201800510).

The death threats followed by the assassination of Gilberto Espinosa Victoria, added to the long list of people specifically included in the letter containing the death threat and the fact that many other Sinaltrainal members have been assassinated over time, has generated great fear and uncertainty amongst our members and their families.

The response to these criminal attacks by the Colombian State demonstrates a clear lack of attention and concern. Despite being well aware of the risks that our members and their families face, State officials continue to dismantle security measures and programs that were established to protect threatened people and limit the establishment of additional measures to guarantee the lives and security of our members and families.

The lack of actions to provide guarantees of the lives and security of Sinaltrainal members and the inefficiency or negligence of the Office of the Prosecutor General as the preeminent investigative unit of the State responsible for ensuring justice is upheld, the safety and well-being of victims of the social and armed conflict, and the prompt investigation and prosecution of all criminal activity, makes the Colombian State responsible for Gilberto’s death. Notwithstanding their knowledge of the death threats against him, the relevant State agencies and officials took no actions whatsoever to guarantee his safety and well-being, even after we had promptly informed the appropriate officials of the facts.

Sinaltrainal condemns this latest crime which constitutes a deliberate attempt to make impossible the effective development of trade union activity, particular when considered in the context of the long list of violent acts and threats committed against members of the trade union movement and against our trade union in particular.

For all of these reasons we demand:

FIRST: That the Prosecutor General investigate the details of what occurred on the 13th of May 2018 in order to determine the immediate and intermediate authors and perpetrators of the assassination of Gilberto Espinosa Victoria and ensure their prompt capture and prosecution, so that the truth can be known and justice served.

SECOND: That the State inform us in writing as to the state of all steps and investigations undertaken by the Office of the Prosecutor General in response to the denunciation we lodged on the 12th of February 2018 (case No. 768346000187201800510) concerning the death threats made against Gilberto Espinosa Victoria who was subsequently murdered on the 13th of May 2018. Further, that the relevant State officials inform us of all measures that have been taken to protect the lives and security of all of our members against whom death threats have been made.

THIRD: That the State guarantee the security and lives of all members of Sinaltrainal, particularly those that have been targeted by specific death threats including Lucio Llanos and Orcar Gordillo and their families, as well as of all Nestlé workers.

FOURTH: We offer our condolences and deepest feelings of solidarity to our comrade Gilberto’s wife and daughter, relatives and friends at this most difficult time.
